The Supreme Court confirms that banks must return lost money to victims of internet fraud

(phishing, vishing, or smishing).


According to a recent Supreme Court ruling, it is the bank that must prove that there has been gross negligence on the part of the customer in order not to return the money. It establishes that clicking on a link in an SMS impersonating the bank or responding to a call from a scammer posing as an employee of the bank's cybersecurity department is not considered gross negligence.


The ruling clarifies that it is the banks that create the risk of these frauds occurring by creating a system of payments and operations through digital banking or applications and it is not reasonable for them to expect their customers to assume the risk of this operation.
