Have you won a prize at a betting house and they refuse to pay you? Have you been banned from betting?
Based on our experience, after having obtained what is very likely the first ruling in the region against one of the most important betting houses like BWIN, we will explain what alternatives you have if you find yourself in that situation.
The first thing we need to know is that when we place a bet through online platforms, contracts are generated between the parties, meaning that if, for example, we are betting on predicting football match results on BWIN, that bet is a contract between BWIN and the person placing the bet.
The betting house first collects the money, but beware, if you win that bet, the operator has to pay you your prize, and that's where the problem sometimes arises.
In the ruling we recently obtained, our client had registered and verified the account; they placed several bets, and while losing, the operator did not express any issues, but when our client won a lot of money, then the ordeal to collect began.
The betting house uses as an excuse for not paying that the winner may have committed some fraud and, to avoid paying, reports the alleged fraud to the competent authorities through the Global Betting Market Investigation Service (SIGMA) and meanwhile the money is withheld.
The first step to be able to collect the money won in the bet is to file a claim with the Directorate General for Regulation. It is almost always in vain, as the Directorate General usually does not take a stand.
In such a case, you would only have the option to go to court.
